HOW TO ENTER:
1. No purchase necessary. Starting October 3, 2008, 11:59 pm (EST), enter online at www.mochasofa.com/winebc, complete the contest entry form with all required information, and follow the on-screen instructions to submit your entry. Limit one submitted entry per person per day. If it is discovered that you attempted to enter more than once per day, all your entries will be void.
2. Neither Transcontinental Media Inc. nor BC Wine (collectively, “Contest Sponsors”) will be responsible for the failure or malfunction of any computer software, hardware or telecommunications equipment affecting participation in or any other aspect of this contest. All entries become the property of Transcontinental Media Inc., which assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received by Transcontinental Media Inc. on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or down loading any material in the promotion. Transcontinental Media Inc. reserves the right (in its sole discretion) to cancel or suspend this contest should a virus, bug or other cause beyond the reasonable control of Transcontinental Media Inc. corrupt the security or proper administration of the contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, Transcontinental Media Inc. reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mutilated, forged, falsified, altered, tampered with in any way, mechanically reproduced, or made through any robotic, automatic, programmed or similar entry duplication method. Proof of sending entry will not be deemed proof of receipt. Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry, provided such person meets the eligibility requirements of these Contest Rules. The “authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. By entering this contest, entrants agree to abide by the Contest Rules.
3. Contest closes November 9, 2008. All entries must be received by 11:59pm (EST) on November 9, 2008.
4. One (1) prize available to be won: One (1) person to attend the WSET Foundation Wine Course: Level 1. Specific details of prize package will be determined solely by Sponsors. Approximate retail value prize package: $469.00 CDN. Course must be completed by December 31, 2009. The dates for these courses are set by Fine Vintage and will vary depending on where the individual who wins lives (i.e. Victoria, Vancouver or the Okanagan). By accepting prize, winner agrees to release Sponsors, their affiliates, subsidiaries, advertising and promotion agencies, and each of their respective directors, officers, employees, and agents, from any and all liability, loss or damage of any kind incurred with respect to participation in this promotion, the awarding, receipt, possession, and/or use or misuse of any prize, or participation in prize-related activities, including but not limited to travel related thereto. The prize is not transferable or convertible to cash and must be accepted as awarded. Contest Sponsors reserve the right, in their sole discretion, to substitute a prize of equivalent or greater value at any time during the promotion.
5. Selection Process: On November 10, 2008, one (1) Winner will be selected by random draw from among all on-line eligible entries received by the contest closing date. In order to win, the selected entrant must first correctly answer a time-limited mathematical skill-testing question and winner will be required to sign a standard declaration of compliance and publicity/liability release confirming compliance with the contest rules and acceptance of the prize as awarded, consenting to the use of their name and photo in any contest-related publicity, and releasing the Contest Sponsors from liability. If a selected entrant cannot be contacted, or the required declarations and releases are not received within the prescribed period, or if a potential winner does not comply with these Contest Rules or is deemed ineligible for any reason, the prize will be forfeited and may be awarded to an alternate winner. The decisions of the Sponsors shall be final in all matters relating to this contest.
6. Selected entrant will be contacted by phone, or email. In the event that the potential winner is not eligible, cannot be contacted by the contest sponsors within seven (7) business days following the draw, does not correctly answer the mathematical skill testing question within the time limit does not sign and return the release forms by December 5, 2008, the Contest Sponsors shall have the right to disqualify that potential winner and to draw an alternate potential winner from all remaining eligible entries received and the Contest Sponsors shall be fully and completely release and discharged from and liability or responsibility in this regard.
7. Eligibility: To enter and be eligible to win, a person must be a legal resident of British Columbia and of the age of majority in British Columbia, and not be an employee of, a member of the immediate family of or domiciled with an employee of Transcontinental Media, BC Wines, or their advertising and promotional agencies. All entries become the property of Transcontinental Media and BC Wine.
8. By entering this contest, entrants hereby grant permission for the contest sponsors to contact them with respect to their entry form and comments. Entrants further agree to abide by the contest rules and the decisions of Transcontinental Media and BC Wine, which are final. Prizes will be awarded and delivered to the confirmed winners by the handling house. The winner will be required to release BC Wine, Transcontinental Media, and their agencies and representatives from liability with respect to the contest and the prize. An affidavit of eligibility and release must be executed. Failure on the part of the selected entrant to return the affidavit by the deadline as noted on the release form may result in disqualification of that person and an alternate winner will be selected from among all remaining eligible entries. Winners agree to authorize Transcontinental Media/BC Wine to announce and publish his/her name, address (city only), and photograph in any forthcoming publicity (including a winner’s list) in connection with this promotion without further remuneration.
9. Contest is subject to all applicable Federal, Provincial and Municipal laws.
